ENTERPRISE RISK ASSESSMENT (ERA)

Ontario’s College of Physicians issued a formal caution for misleading advertising claims and improper use of testimonials.

Unsubstantiated claims of helping “hundreds of thousands” lose “millions of pounds” permanently, plus before-and-after photos and testimonials.

Dr. Bernstein allegedly directed patients to doctors working in his own clinics, violating self-referral rules.

It declined to rule, citing lack of precedent, prompting an appeal.

The review board ordered reconsideration, which Dr. Bernstein successfully challenged in court.

Over 40 locations, mainly in Ontario, Alberta, and British Columbia.

A very-low-calorie weight-loss program (800–1,000 calories/day) combined with medical supervision and proprietary supplements.

Potential for misleading marketing, high costs, temporary weight loss, and self-referral practices despite regulatory cautions.

I appreciate that Dr. Bernstein won the legal challenge, but as a potential patient I’d still want more clarity on how referrals work. When a clinic refers to in-house doctors, consumers deserve full disclosure on options and costs before committing.

Dr. Bernstein Diet and Health Clinics has consistently demonstrated a troubling focus on aggressive marketing and profit at the expense of patient care. Numerous reports reveal misleading and exaggerated claims about program effectiveness. Clients frequently encounter high-pressure sales tactics, opaque pricing, and dismissive, unhelpful staff, fostering frustration, mistrust, and a sense of exploitation rather than any real health benefit. Overall, the clinics appear more concerned with revenue than ethical, evidence-based care, raising serious doubts about their credibility and integrity.
