Dennison v. Rosland Capital LLC

Mr. Dennison, an 82-year-old veteran Navy pilot, replied to Rosland Capital’s television advertisements in 2016 about precious metal investments. He was convinced to invest about $150,000 in gold and silver coins by Mr. Smith, a representative. Due to his lack of financial knowledge, Mr. Dennison signed an agreement without realizing it had a secret arbitration provision. He filed a lawsuit against Rosland Capital after learning the coins were worth a lot less than what he had paid. The deal was declared unjust by the court, notwithstanding their attempts to compel arbitration. The judge declared:

1. The arbitrator’s authority to determine fairness was not expressly granted by the arbitration provision.
2. The arrangement was unjust as it disproportionately benefited Rosland Capital: it made Mr. Dennison submit to arbitration but excluded Rosland Capital.
It capped damages and restricted Rosland Capital’s culpability.
It reduced the amount of time Mr. Dennison could file a claim.
3. Removing a single clause from the agreement wouldn’t address the injustice since it was so widespread.
Consequently, rather than making Mr. Dennison submit to arbitration, the court let him continue with his complaint.

This resulted in an unresolved problem and continued irritation. All things considered, the person strongly recommended that people avoid Rosland Capital and said that they would like to give them a rating of zero stars.
