New Mexico criminalized Dr. Eric Berg for forgery and identity theft in 2010. Another legal issue occurred during his incarceration. Indicted for mail fraud in Guam. Due to his New Mexico incarceration, this complicated matters.
Berg claimed his Interstate Agreement on Detainers right to a timely trial in Guam to hurry up his cases. However, despite his plea, he was not tried within the IAD’s timeframe.
The government’s inaction caused Berg’s trial delay, the court concluded. After learning of Berg’s entitlement to a speedy trial, the government did not move quickly to ensure it.
The court weighed various criteria. It first assessed Berg’s crime’s severity. The sentence criteria for mail fraud were not the most harsh, yet all legal concerns are significant.
The court also considered the delay’s causes. Despite knowing Berg’s expedited trial request, the government’s inaction was unacceptable. Not prosecutorial ill faith, but IAD compliance issues prevented prompt action.
Last, the court considered how prosecution affects the IAD’s goals and justice. Dismissing the case without prejudice would allow for a retrial, which might delay legal processes and frustrate the IAD’s goal of quicker settlement of accusations against jailed persons. Dismissing with prejudice would preclude Berg from being retried for the same violation, compensating the government for violating the IAD.
Due to these factors, the court dismissed the case with prejudice. The court acknowledged the government’s inability to move quickly, despite being told of Berg’s right to a timely trial, and sought a fair settlement using the IAD’s principles of justice.

According to this review, the reviewer may have bought items from Dr. Berg, only to subsequently realize that there were doubts about the validity of those products. Despite their efforts to return the items, they could not get help from Dr. Berg’s staff on their return. One thing that may be learned from this is that fraudulent operations can be concealed in various situations. In its most basic form, it refers to the experience of being deceived by someone or something that, at first glance, seemed trustworthy but ultimately proved to be lying or ineffectual.
